Terms of Use and Waiver
Last updated October 24, 2026 · Version 2026-10-24 · Draft pending legal review
Please read these terms carefully. They include a waiver of claims, a promise not to sue, a limit on damages, a one-year time limit for claims, and a waiver of jury trials and class actions. Phone-Clone is made and sold by Ducklark LLC, 418 Broadway Ste N, Albany NY 12207 ("Ducklark LLC", "we").
1. Early release
Phone-Clone is a product under active development. It may have errors, may stop working when Google, Samsung, Microsoft or others change their software, and may lose, damage or expose information.
2. Your agreement
You must accept these terms, by ticking each box in the program, before using Phone-Clone, and again before buying a plan. If you don't agree, don't install or use Phone-Clone.
3. Provided "as is"
PHONE-CLONE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. DUCKLARK LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, SECURITY, ACCURACY AND AVAILABILITY.
4. Keeping your computer safe is your responsibility
Phone-Clone stores copies of texts, calls, contacts, files and sign-in codes on your computer. You alone are responsible for protecting your computer, phones, accounts and network, for keeping backups, and for deciding whether to use the sign-in-code features. No software can be made impossible to hack.
5. You accept the risks
You understand and accept the risks of using Phone-Clone, including someone getting into your computer, phones or accounts without permission; theft or exposure of messages, codes or personal information; account takeover and financial loss; lost or damaged data; and messages sent by mistake, or not sent.
6. Waiver, release and promise not to sue
TO THE FULLEST EXTENT THE LAW ALLOWS, YOU WAIVE, RELEASE AND PROMISE NOT TO SUE DUCKLARK LLC OR ITS OWNERS, MEMBERS, EMPLOYEES OR CONTRACTORS OVER ANY CLAIM ARISING FROM OR RELATED TO PHONE-CLONE, INCLUDING ANY CLAIM THAT PHONE-CLONE CAUSED OR CONTRIBUTED TO A HACK, A DATA BREACH, THE EXPOSURE OR LOSS OF INFORMATION, ACCESS TO AN ACCOUNT WITHOUT PERMISSION, OR FINANCIAL LOSS. THIS BINDS YOU AND ANYONE CLAIMING THROUGH YOU, INCLUDING YOUR HEIRS.
7. Limit on damages
TO THE FULLEST EXTENT THE LAW ALLOWS, DUCKLARK LLC IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, MONEY, PROFITS OR ACCOUNTS. ITS TOTAL LIABILITY FOR ALL CLAIMS TOGETHER IS LIMITED TO WHAT YOU PAID FOR PHONE-CLONE IN THE 12 MONTHS BEFORE THE CLAIM, OR $10 IF YOU PAID NOTHING.
8. Your only remedy
If you are unhappy with Phone-Clone for any reason, your only remedy is to stop using it and, if you paid, ask for a refund.
9. One year to bring a claim
Any claim must be brought within one year after it arises, or it is permanently barred.
10. You cover misuse
You will defend and hold harmless Ducklark LLC, including paying its reasonable lawyers' fees, against claims from anyone whose phone or information you connected, against claims arising from your misuse of Phone-Clone, and against any claim you bring that these terms waive.
11. No other promises
Nothing on this website, in an email, in support or in the program is a promise or warranty unless it is in these terms. This does not change the commitments in our Privacy Policy, which we keep.
12. Lawful use and agreement
Use Phone-Clone only on your own phone; a phone your business owns, with the person using it told in writing; a parent's phone, with the parent's agreement; or your own child's phone while they're under 18. Always use it openly, and never on another adult's phone without their agreement. You must be 18 or older.
13. Other companies
Phone-Clone relies on software and services from others, including Google, Samsung, Microsoft, Anthropic, Tailscale and Paddle. Ducklark LLC isn't responsible for them. When you buy, our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle handles order, payment, billing and refund questions; we answer questions about the program.
14. Disputes
New York law applies. Disputes are settled by individual binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, held in New York or by video. YOU WAIVE ANY RIGHT TO A JURY TRIAL AND TO TAKE PART IN A CLASS OR GROUP ACTION. Small-claims court remains available.
15. If a part doesn't hold
If a court finds any part of these terms unenforceable, the rest still applies, and that part is enforced as far as the law allows. Nothing in these terms limits liability that the law does not allow to be limited.
